Merry Christmas to Peter Wilson. When it was suggested that Peter Wilson should be independent of the old board so that we can have a fresh start Peter responded with "That's your issue". Summary of the meeting here: viewtopic.php?f=23&t=594
A good summary of where we are up to by Joe Aston of the AFR, linked to from here: viewtopic.php?f=5&p=4137#p4137

Top job. Why is it so hard for them to follow the law?

I'm using my phone and so that PDF won't download properly – what's the gist of the breach?

Missing member register information.

Email addresses
Designation, ASA, CPA FCPA
Former and retired members and their contact details

Guys,

Let's not get ahead of ourselves here. I understand and empathise with your frustrations, but have a look at this article from the Good Governance Institute:

www.governanceinstitute.com.au%2Fmedia% ... gister.pdf

It specifically says that email addresses should not be provided in response to such requests.

The main concern is the member status. What should be provided is a copy of the register, rather than some collection of information. Member status is on the register. Whatever is on the register gets provided as it's a copy.

Raleighcpa, Whilst I respect your right to voice your opnion, the legislation has not kept up with technology, where electronic communication has largely replaced snail mail as the primary means of communication. The board have deliberately withheld this to hinder and make it cost prohibitive to communicate through traditional means. This is clearly against the intent of the legislation. This flaw has been recogised senator Zenaphon who has drafted this private members bill to ammend the act.

The correct link is:

http://www.governanceinstitute.com.au/m ... gister.pdf

What you get is a copy of the register. Whatever is recorded on the register you get it. If the organisation has member status on the register you get member status. The CPA Australia constitution and by laws clearly state that they record member status on the register but it was not in the "copy" provided.

There is no complaint about email addresses. If not on the register they cannot give it. Fine. Some people asked, is it really not on the register. Who knows how that works there is no proof that it is. We were hoping it would be. Given the member status is redacted then the question does arise about what else is redacted.

I think the premise of the argument is that CPA Australia has, by conduct, made the email addresses relevant (i.e. the email sent out to all members after the register was given, not a mailed letter). I can't see an argument for not giving them to Brett if they are using it as their primary form of communication.

Just checking the Senate website...

https://www.legislation.gov.au/Details/C2017B00123

http://www.aph.gov.au/Parliamentary_Bus ... ?bId=s1070

Progress:
Senate
Introduced and read a first time 15 Jun 2017
Second reading moved 15 Jun 2017

I won't claim to know exactly how this works, but i think now it goes to the House of Reps and if it is passed, goes to the G-G to become law?

That's my understanding deanus, however the house of reps may have other priorities at the moment? There may be a delay.

I am right in my interpretation that after royal assent it can take 6 months before it's law.

https://www.legislation.gov.au/Details/C2017B00123
A single day to be fixed by Proclamation.
However, if the provisions do not commence within the period of 6 months beginning on the day this Act receives the Royal Assent, they commence on the day after the end of that period.

Goes to committee, third reading, then the same process through the house then GG for signature.

Write up on it here, http://www.peo.gov.au/uploads/peo/docs/ ... ng_law.pdf remembering in this case house and senate are swapped around.

Still months off.
